For a commercial property, responsibility for ensuring the building has a valid Gas Safety Certificate will be dependent on the lease, but it is important to note that if the lease gives responsibility to the tenant, the owner or managing agent must be confident that the tenant is carrying out their duties, and will still be responsible for the Gas Safety in the communal areas.


What are your obligations?

 The Gas Safety (Installation and Use) Regulations 1998 state that if you are responsible for the Gas Safety in a commercial property it is your job to make sure any relevant gas fitting is maintained in a safe condition.  This includes ensuring that, “each appliance and flue to which that duty extends is checked for safety within 12 months of being installed and should be checked at 12-month intervals.”

You must ensure that all works are undertaken by an approved Gas Safe registered engineer and keep records of the annual Gas Safety Inspection for a minimum of 2 years.


What are the implications of non-compliance?

 Compliance is a legal responsibility.  The Health and Safety Executive warns that you could face a large fine or imprisonment if the consequences of you neglecting your responsibilities result in death.
